How can i check my cell phone to see if it has spyware or is being accessed?

Are you having problems with the device?
What type of phone is it? model? If it is a PDA of some sort is it linked to a company server for email?

I really doubt if your phone has any malware on it. It is not a Windows Mobile device so the user base is so limited that any hacker creating malicious code is not going to waste his time for such a small user base.
If you do suspect for any reason that there is anything on your phone that should not be there you can always take you phone to the carrier and they can re-flash the device software though.
