from the little bit i have read on it
a number of years ago the shoe was on the other foot and they set a precedent,which means they will lose this case
so they don't want the courts to wipe it out,just not be influenced by it in making there decision in there favour
then you will have two precedents on opposite axis
it appears they want their cake and eat it to
crazy
