Hamburg entrepreneur Daniel Giersch has won a legal dispute with Google concerning the Gmail brand. The Hanseatic Upper Court has now ruled (Az 5 U 87/06) prohibiting Google from using "Gmail" for its e-mail service in German. The court has not yet handed down any written statement. Daniel Giersch's lawyer Sebastian Eble stated, "The Hanseatic Upper Court felt that the law was so clear that it has not even allowed its ruling to be appealed to a higher court." For users, the new ruling changes nothing. Google's "Gmail" service has already been called Googlemail for some time in Germany.
