questioning ip connection

Hi guys

Trying to be more specific, I´m just gonna say I think someone that I suspect I know is hijackin my computer. Before I send you a report from hijackthis i have a couples of questions I´d like to know the answers:

1.- Is there any chance for someone to take over my IP address?, so no matter if I switch pcs, it still could be manipulated??

2.- If I use services like windows live messenger using my email account is good enough to get hacked??

3.- which programs do you recommend to specific know from who am I connected, and, if there´s a chance, to have proof enough to sue this guy before he has any chance to disconnect from my pc??

Can you tell us how you are connecting to the net and what hardware is involved?
