Hard drive or windows error ?

Hi All,
I got a bit of a problem that i need to resolve, a couple of weeks ago i took my computor to a computor shop to upgrade from Win Me to Xp, the computor was working ok, before this, i just wanted to have the newer XP running insted of WIn ME.
About 2 hours after i dropped my computor off at the shop, they phoned me and told me they were having problems with installing XP, they had noticed a sticker on it from the initial tech who installed the new hard drive on it about 7 months ago, so they told me to take it back to that guy, because it still had a few months left on the warrantry.
So i did take the hard drive back to the origanal tech of whom installed the hard drive and left it there.
About 15 minutes latter he phoned me and said there is nother wrong with the hard drive so come and pick it up, so i did.
I took it back the other tech and told them what he said, they said ok then we will try again, that was fine.
So to all events about 3 hours after that they phoned me and told me that the hard drive was not installing XP, they had removed the existing partition and reformmatted it, then XP copied all the files for the install then after the system needs to reboot, but it would not boot through to install the operating system, there was an error loading operating system, they also tried the hard drive in a new system and same thing it would not work, it said error loading operating system, the excactly the same message.
So they installed a new hard drive and every thing is working fine.
The first tech will not except that the hard drive is no good therfore i am the looser out of all this, it cost me $175 to put a new drive in.
The tech that will not honor his warrantry, says its an windows error not a hard drive error and will not replace my hard drive, so i have a working system thats alright but i am stuck with the old drive, and $175 out of my pocket, which is a bit hard because i am on a very low income, a disabilty pension, but those are the breaks.
I would like to hear what you think, i have tried to get a new hard drive from the manufactoria[ Maxtor] but they say i have to go through the tech who installed it in the first place, what a headache, i really don't know what to do next.
I would appreciate your opinions.

I'm suprised you're getting such a run-around, the guy that sold it is one thing, but the manufacturer's handling of this is suprising. Can you find a warranty date on the drive? And is it a two year?

Yeah mate its unreal, all this for a lousy hard drive, and yes the tech that installed the initial hard drive left a sticker with his business name and date of instalation, and i believe that it has a 1 year warrantry on it, about 5 months left of warrantry.
I have emailed Maxtor again telling them they stuffed up, and i am waiting to hear from them.
