Subnet masks do not necessarily have to be the same although it is a good idea. What is important is that both IP addresses are in the same subnet as defined by the most restrictive of the subnet masks. In this case they are so communication works.
In addition, when it comes to performing routing it is bad practise to have overlapping subnet masks as your chances of causing routing loops or routing black holes increases greatly.
You will find that not all devices within the subnet ranges will be able to communicate with each other due to the subnet masks relationship with when the default gateway is used.
