Yeah, I'd say that the District would appear to be on thin legal ice with the ban. I'm surprised that there wasn't a serious challenge years ago. When I lived in Northern Virginia, I often had to go into the nastier parts of Northeast and Southeast D.C., and I have to say I don't think I could have carried enough firepower to make me feel secure, even in the daytime. Crooks and civilians both were already heavily armed and prepared to use their weapons. The ban is basically a joke from a practical standpoint.

Perhaps I like this one as well...

I really hate to say this...but...thank god Bush stacked the Supreme Court with staunch conservatives...taking the right to bear arms away from citizens would be the last straw....

if DC wins then its a sure sign that America as we know it is over....I'm quite sure out founding fathers understood that some time in the future a second revolution might be required....as Benjamin Franklin said "we've given you a great republic...now lets see if you can keep it"

anybody up for a million man march on DC with everyone armed to the teeth so that we can kick the corrupt politicos out?

Wozer, the legal interpretation of the Second Amendment on which D.C. bases its ban dates all the way back to a Supreme Court decision in 1939 on the right of an Arkansas bootlegger to carry a sawed-off shotgun across a state line. So, even if the Court upheld the ban, it would be an affirmation of the status quo. Of course, that ain't happenin'. What I'm really interested in is seeing how the court deals with the issue of reasonable regulation. Let's face it, the Court isn't going to write a decision that interprets the "right to keep and bear arms" as legalizing private ownership of thermonuclear devices and nerve agents.

My guess is they'll chicken out by saying something like: The 2nd Adm deals with State's and militias but since DC is not a State it can't have a militia so the 2nd Adm doesn't apply to them. They can do what they want to do.
