emergency brake repair

my E brake works but the pedal will not stay locked in it keeps coming up it wont stay engaged can anyone help me with this problem

Emergency brakes are actuated differently between car models and countries. In Oz most locally manufactured cars have a lever (not a pedal) that is used to activate them. The make and model of your car would be helpful, but as a generalisation, most hand brakes work by having a ratchet and pawl arrangement. The pawl is spring loaded and engages the ratchet gear when applied (to lock it on). The pawl is retracted when you release the brake (either by press a button or pulling a lever). I would suspect that in your case the pawl spring is either worn or broken. Replace the spring and it should work just fine.
