A good temporary fix would be to disable the accupoint or touchpad in device manager and then use a wired mouse in its place.

You may want to look into calling the warranty HQ- they'll probably be more keen on getting it repaired than replaced, unless toshiba's warranty dept is as absolutely atrocious as I hear it is...
