I guess my thoughts are that the toy isn't even a BB gun, and it hs it's nationally-mandated orange barrel to differentiate it from a real firearm.
I sure hope that the NRA, et al, hop in this one, as we cannot affort to have that case law on the books. One of thekids was charged with assault with a dangerous weapon? Unless he is inbound to a total Kangaroo Court, therewhould be a dismissal of that charge, quickly.
Airsoft does manufator BB guns, pellet buns and painball guns, and the pellet gun could do some damage to a human, for sure. These kids were playing with a childs' toy. and it doesn't have the power fo injure an eye, even at point blank range.
We reaslly need to increase the education requirements of law officers everywhere. Over time, an applicant should have a bachelors' degree in a related subject to apply. We do seem tobe having a lot of difficulty with the competency of officers, from OJ to MJ to N.O, where they apparently went home.
The story above is just one more black eye against officers, prosecuters, et al.
