Technically its illegal and certainly would be if you were say making a profit from their roms.

Even if the game is not commercial available it does not change its copywrite status.

this however is not stopping people distributing emulators and roms.
I think if you were hosting a site selling them it would be a different matter.
It's interesting to see just how greedy corporate entitys are. To complain about the usage of defunct, unbuyable, discontinued sofware is just sad. I'de bet my left jewel that nintendo wouldn't lose a dime if i were to download and play "Zombies Ate My Neighbors". A game that not only have i already bought, but i couldn't buy again even if i wanted to.

Shame, i threw out that old cartrage only a year or so ago. Noticed it had a decade+ old chocolate milk stain on it.
